Terms and Conditions

Welcome to Off Fire Online. These Terms and Conditions serve as a legally binding agreement between the Platform (referred to as 'We' or 'Platform') and the User (referred to as 'Client' or 'User'). By using the platform, browsing it, or requesting any of its technical or consulting services, you explicitly acknowledge that you have read, understood, and fully agreed to these terms without restriction or condition.

Article (1): Definitions

  • Platform: Off Fire Online digital platform, operating in engineering brokerage and technical consulting for safety and security systems.
  • Client (User): Any natural or legal person (facility owner, investor, company) using the platform to request quotes, consultations, or contract for safety system execution.
  • Service Provider (Third Party): Companies, consulting engineering offices, and suppliers certified and classified by the General Directorate of Civil Defense and competent government authorities, linked with the client via the platform.

Article (2): Nature of Platform's Work

  • Brokerage and Consulting: Off Fire Online acts strictly as a digital broker and independent engineering consultant. Our role is limited to technically linking clients with service providers and filtering quotes to ensure SBC compliance. The platform is not an executing contracting company.
  • Independence from Government Entities: The platform is a private technological entity and does not represent the Civil Defense, Ministry of Municipalities, or official portals like 'Salama' or 'Balady'.
  • Contractual Relationship Nature: Any final contract for execution, supply, or maintenance is concluded directly between the (Client) and the (Service Provider). The platform is not a party to this contract.

Article (3): Limitation of Liability

Under no circumstances shall Off Fire Online be legally or financially liable for the following:

  • Any errors, manufacturing defects, or negligence in field execution by the service provider.
  • Delays by the service provider in delivering the project or issuing required certificates on time.
  • Any material losses, business interruptions, or fines imposed on the client due to government refusal to complete licenses for reasons attributed to the contractor or the facility's condition.
  • Advisory information provided by the platform represents engineering recommendations based on the Saudi Code and does not constitute a final guarantee of passing government inspections.

Article (4): Disclaimer Regarding Government Licenses

  • The platform disclaims all responsibility if 'Salama' or 'Balady' portals reject license issuance due to the client's administrative or regulatory reasons (e.g., suspended CR, labor violations, unpaid fees).
  • The platform is not responsible for the failure or delay in issuing the 'Installation Completion Certificate' if manipulation by the executing contractor is discovered, or if the client alters approved plans without consulting the engineering office.

Article (5): Client Obligations

The client pledges and commits to the following:

  • Data Accuracy: Providing correct information, areas, and engineering plans matching the actual site. The client bears any additional costs or fines resulting from misleading data.
  • Financial Commitment: Paying all financial dues to the service provider according to the contract's payment schedule.
  • Site Readiness: Preparing the site for construction works, inspections, or material delivery on scheduled dates.
  • Previous Violations: Bearing full responsibility for any prior structural or operational violations hindering license issuance.

Article (6): Pricing Mechanism & Technical Analysis

  • Initial quotes are based on data and plans uploaded electronically by the client.
  • The service provider and platform reserve the full right to amend the final quote if fundamental discrepancies are discovered during the site inspection visit.
  • The 'External Quote Evaluation' service clarifies the technical fairness of the offer based on the SBC, and does not oblige the platform to compensate the client for subsequent market price fluctuations.

Article (7): Data Sharing & Technical Privacy

By agreeing to these terms, you grant Off Fire Online explicit authorization to:

  • Share engineering plans, site reports, and technical data of your facility with service providers registered in our database.
  • This sharing is strictly limited to studying the project and providing accurate quotes, with the platform committing not to use data for external commercial purposes.

Article (8): Technical Arbitration & Dispute Management

  • In the event of a purely technical dispute between the client and the service provider regarding installation quality or SBC compliance, Off Fire Online may intervene, upon request, as a neutral technical consultant.
  • The platform's opinion in this case is an 'engineering advisory' opinion, not legally binding, and does not waive any party's right to resort to judicial authorities.

Article (9): Termination of Service

Off Fire Online reserves the absolute right, at its sole discretion, to:

  • Temporarily or permanently suspend any user's account if proven to violate these terms, attempt fraud, or provide misleading data.
  • Refuse service to any facility without stating reasons, to protect the platform's integrity.

Article (10): Intellectual Property Rights

All intellectual property rights related to the platform (logo, visual identity, texts, designs, workflow, articles, and technical filtering algorithms) are the exclusive property of Off Fire Online. Unauthorized copying or reproduction is strictly prohibited and subject to severe legal accountability.

Article (11): Amendment of Terms & Conditions

Off Fire Online has the right to amend, add, or delete any clause of these terms at any time without prior notice. Continued use of the platform constitutes final acceptance of the modifications.

Article (12): Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. In case of any legal dispute arising from the use of the platform that cannot be resolved amicably, exclusive spatial jurisdiction lies with the competent courts in Saudi Arabia.
